Terms of Service – Beara Compass™

1. Who We Are

Beara Compass™ is a sole trader business based in Ireland. By using our website (bearacompass.ie) or purchasing products, you agree to these Terms.

2. Eligibility & Accounts

• You must be at least 18 or have permission from a parent/guardian to purchase.
• You’re responsible for maintaining the confidentiality of any account credentials and for all activities on your account.
• We may refuse service, close accounts, or cancel orders for misuse, fraud, or policy violations.

3. Ordering Process

• Your order is an offer to buy; acceptance occurs when we dispatch your item(s) and send a shipping confirmation.
• If a product is out of stock or on backorder/pre-order, we’ll update you with options: wait, swap, or cancel for a refund.
• We may contact you for additional information to verify or complete your order.

4. Pricing, Taxes & Currency

• Prices, product details and availability may change without notice. Obvious errors (typographical or pricing) may be corrected and impacted orders cancelled/refunded.
• Displayed prices may exclude shipping, duties, or import taxes (see Section 7).
• Currency display is for convenience; your payment provider may apply conversion and fees.

5. Payments & Fraud Checks

We accept:

• Credit/Debit Cards
• PayPal
• Apple Pay
• Google Pay

Payments are processed securely by trusted partners. Beara Compass™ does not store card details. We may use automated and/or manual checks to prevent fraud. We reserve the right to decline or cancel orders where payment cannot be authorised or fraud is suspected (prompt refund will be issued if charged).

6. Shipping, Delivery & Risk

• We ship worldwide. Delivery times depend on destination and carrier. Estimated dates are not guaranteed.
• Risk of loss passes to you upon delivery to the address provided or upon hand-off to the carrier if you arrange your own collection.
• Lost or Damaged Parcels: Notify us within 7 days of the delivery date (or expected date) at info@bearacompass.ie. Keep packaging/photos for carrier claims.
• Incorrect Address/Failed Delivery: If a parcel is returned due to incorrect address or uncollected delivery, we can reship (additional postage may apply) or refund the item price less original shipping.

7. Customs, Duties & Import Restrictions

• International customers are responsible for all customs duties, taxes, brokerage fees and complying with local import laws.
• We are not liable if local authorities seize or delay shipments due to import restrictions or documentation requirements.

8. Returns, Refunds & EU Right of Withdrawal

We want you happy with your gear. We offer a 30-day return policy (customer-friendly):

• Items must be unused, in original packaging and resaleable condition.
• Email info@bearacompass.ie within 30 days of delivery to start a return.
• Refunds go to the original payment method once we receive and inspect the return.
• Original shipping is non-refundable unless the product is faulty or we made an error.
• Unless faulty, return postage is your responsibility (we’ll advise the best method).

EU Consumers: Your statutory rights include a 14-day right of withdrawal for most online purchases. If you exercise this right, you must notify us within 14 days of delivery and return items within 14 days of notice. We will refund the product price and the standard delivery cost, per EU rules. Deductions may apply for diminished value due to handling beyond what’s necessary to establish the nature, characteristics and functioning of the goods.

Non-returnable items (unless faulty): perishable goods, personalised items made to your specification, and items marked final sale.

9. Product Info, Use & Safety

• We aim for accurate descriptions, photos and specs, but minor variations (colour, finishes, materials) can occur.
• Follow all instructions, warnings and maintenance guidelines. Outdoor activities involve risk. You are responsible for proper selection and safe use.
• Beara Compass™ is not responsible for accidents, injuries, or damages arising from misuse, improper assembly, modification, or failure to follow instructions.
• Where a manufacturer warranty exists, your statutory rights are unaffected; keep proof of purchase.

10. Intellectual Property

All content on bearacompass.ie—including the Beara Compass™ name, logo, product images, text, graphics, and designs—is owned by or licensed to Beara Compass™ and protected by applicable laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

11. User Content & Reviews

• If you submit reviews, photos or comments, you grant us a non-exclusive, royalty-free, worldwide licence to use and display that content for marketing and store operations.
• Don’t post anything unlawful, misleading, infringing, defamatory, or harmful. We may moderate or remove content at our discretion.

12. Promotions, Coupons & Gift Cards

• Promo codes and offers are subject to terms, time limits and availability. One offer per order unless stated otherwise. No cash alternative.
• Gift cards (if offered) are redeemable only on bearacompass.ie, are non-refundable and may have expiry dates as permitted by law.

13. Third-Party Services & Links

Our site may link to third-party sites or use third-party services (e.g., payment processors, shipping carriers). We’re not responsible for their content, policies or practices. Your use of those services is governed by their terms.

14. Limitation of Liability

To the fullest extent permitted by law, Beara Compass™ will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or use, arising from your use of the site or products, even if advised of the possibility. Nothing in these Terms seeks to exclude or limit liability that cannot be excluded under applicable law (including your statutory rights as a consumer).
